TIMBERLOOP - DIGITAL TAKE BACK PROGRAM TERMS & CONDITIONS

Effective date: these Terms and Conditions were released on March 1st, 2022 and are effective as of that date.

1. What is this document for?

These Terms & Conditions regulate your participation to the TIMBERLOOP – DIGITAL TAKE BACK PROGRAM (“Program”). When you decide to participate to this Program, you confirm your acceptance of these Terms & Conditions and, if you do, a contract is formed between you and us. So, it is important that you read these Terms & Conditions carefully before taking part in the Program. The Program is owned and operated by VF INTERNATIONAL S.A.G.L., whose registered office is at Via Laveggio, 5, 6855 – Stabio, Switzerland, Company Registration number Stabio - CH-514.4.028.163-8, VAT Number CHE-111.650.898, in partnership with ReCircled S.r.l. (“ReCircled”), Via F. Ferrucci 57, 59100 Prato (PO) – Italy ("Timberland" or "we").

Through the Program, you can give to used Timberland products another life. We will clean, repair or recycle products that you don’t want anymore.

Your taking part in the Program allows us to extend the life of your old Timberland items making this world a more sustainable place. As a thank you for participating, we give you a 10% off promocode, to be used on Timberland.co.uk.

2. How to participate to the Program

If, together with your Timberland official e-commerce order, you have received a bag at home, you can decide to use it to return any Timberland item that you no longer use or that you simply don’t want anymore (regardless of its conditions). We will inspect the products returned, those that can be repaired and cleaned will be resold on a second hand platform, while those that are beyond repairing will be recycled to give them a new life.

Please note that the bag is not to be used to make returns and request refunds in the context of your right of withdrawal of warranty rights. Please follow our Return Terms for that.

You have to place your used Timberland item(s) into the bag received, remove the self-adhesive strip and seal it.

Afterwards, you can drop the bag off at the nearest Yodel point. To find the nearest Yodel drop-off point, you can visit the website https://bit.ly/3k83foX.

In order to participate to the Program, the bag must be sent to us no later than May 15th 2022.

Please note that only items purchased from Official Timberland retailers, Timberland retail stores or official e-commerce platforms can be returned

3. What happens when you give back your items?

By giving back your item(s) to us in the context of this Program, you agree to immediately and irrevocably transfer the property of the items to ReCircled Srl. Therefore, under no circumstance either Timberland or Recircled shall have any obligation to return the item(s) to you.

4. Your representations and warranties

You hereby represent and warrant that (a) you have good and marketable title to each items and have the right to sell and/or donate the items; (b) none of the items is subject to any liens or other encumbrances; (c) the items do not include stolen or counterfeit items or items that are illegal to sell; and (d) to the extent this is under your control, the items do not infringe upon, misappropriate, or violate any trademark, copyright, or other intellectual property or other proprietary right of any third party, any applicable law, order, rule or regulation.

5. Counterfeit or stolen items

You are responsible for ensuring the authenticity of all items you provide to us. Our authentication process is proprietary and independent. If we cannot verify the authenticity of an item contained in the bag you send us, or the item does not otherwise meet our authenticity standards, we reserve the right to destroy or recycle it if it deems to be counterfeit in accordance with applicable laws. You acknowledge and agree that any item determined to be counterfeit will not be returned to you.

6. Promocode

By taking part to the Program, you have the right to receive a 10%-voucher (“Promocode”) to be used on our Timberland.co.uk website. In order to receive the Promocode, you can alternatively visit the following link https://bit.ly/3jsQViJ or scan the QR Code on the bag. Scanning the QR Code or visiting the above-mentioned website you will be asked to fill out a provided form where you have to insert your email address to receive the Promocode.

You can use the Promocode only on www.timberland.co.uk. The Promocode will not be redeemable in retail stores.

The Promocode is valid for one-time use only. The Promocode expires on April 30th, 2022 (extended until the 31st of May 2022).

If not otherwise specified, the Promocode cannot be combined with other coupons, offers or discounts. The Promocode cannot be transferred, reproduced, altered or sold. We are not responsible if the Promocode is lost, stolen, destroyed, damaged or used without your permission. The Promocode cannot be redeemed for cash.

The Promocode applies to full price Timberland merchandise only and does not apply to gift card purchases or any sales tax.

Offer is available for a limited time only and subject to change at any time without notice.

In case of returns of orders for which a Promocode has been redeemed, Timberland shall refund the actual purchase price you have paid for such order, net any discount, including the discount related to the use of the promocode.

7. Are my personal data collected and processed in the Program?

By taking part to the Program, you agree that we may store, process and use your personal data for the purpose of sending you the Promocode. We will process your information in accordance with our Privacy Policy.

8. General

Our Terms & Conditions of Sale apply to this Program, where applicable. This Program may be changed or discontinued without notice.
